9 Proceedings for the condemnation of any thing instituted in a magistrates’ court in England or Wales, in the sheriff court in Scotland or in a court of summary jurisdiction in Northern Ireland may be so instituted—
(a) in any such court having jurisdiction in the place where any offence in connection with that thing was committed or where any proceedings for such an offence are instituted; or
(b) in any such court having jurisdiction in the place where the claimant resides or, if the claimant has specified a solicitor under paragraph 4 above, in the place where that solicitor has his office; or
(c) in any such court having jurisdiction in the place where that thing was found, detained or seized or to which it is first brought after being found, detained or seized.

That simply explains that there is a theoretical chance of having (condemnation) proceedings heard other than in the jurisdiction of the court closest to the point of seizure. Since UKBF are back in momma's Home Office nest again that could be taken to include the City of Westminster as well. However the odds of a Dover magistrate allowing it to be moved to a less biased venue are so close to nil that they share the same post code if not front door.

My complaint about the treatment I received from Maidstone Crown Court has now been posted, but I expect the holidays to get in the way of rapid delivery.


They lie on recordings; they lie on oath; their shysters lie on their behalf. Don't believe a word coming from the mouths (2 per person) of any UKBA officer.

Sorry to hear about your farse at Maidstone, but then again I drift expect anything less,
I sent off my adjournment, and heard nothing back :-/

I'm only guessing they have adjourned it as I havent had any mail to say other wise.

I've now got solicitors threatening me with legal action over £120 even though they had £600 off me for one measly letter with so many errors and inconsistencies my 8 year old could have done better.

So will keep you upto date with my progress.

as many of you know i had my PTR which lasted all of 10 mins, :-/

My date has been set for the 22nd, i have instructed council on this case as its gone a bit too far to handle on my own.

the judge cracked a smile when he was told by my barrister that we handed over statements of truth to BF officers on our stop, and apparanlty this judge is very strict and doesn't often see the funny side of things, really don't know why he was amused? he did asked if we signed them and again he cracked a big smile??  could be good, could be bad if it could go against me?? who knows??, i suppose we'll know on the 22nd.

If I can tie this in with a trip over then I'd like to be there. I wasn't planning on doing a baccy run 'til at least mid June so no promises.

Border force submitted their cert 144 and the judge signed it so I'm 2k down on legal fees as I can't claim that back, but we WON :-D

We got our day in court and WON justice prevails, I'm glad I can draw a line under this now :-D

You guys were always right. Finally 2 years of misery all gone

Just need to get some sleep now as it was an exhausting day.

well done mrc, its a shame that they get away with it and get cert 144 but they will leave you alone now as they scared of people who stand up and fight.

I know, but still down on travel costs aswell as it's cost me 200 quid every time I've stayed over. Inc fuel and hotels etc,

3 times I've had to travel down.
