Recording and SOT in action.

There will be members here who'll remember Mr and Mrs Donny and their battle in Doncaster court. For those that don't ... http://nothing-2-declare.blogspot.co.uk/p/day-we-beat-and-outed-ukba-in-court.html

No longer do they go abroad unprepared and last night this happened :-

Upon returning to EMA from Bulgaria and disembarking, Mr Donny switched his Sony recorder on. They went through passport control and then to baggage reclaim. Their first suitcase arrived quickly but the one with 50 cartons of cigarettes and a couple of kilos of tobacco did not. lt was the last to arrive.

They then made their way to the exit and were waylaid by Border Force. There were 3 BF officers and 3 policemen.

Mr Donny immediately informed the particular BF officer that was dealing with him and Mrs Donny that he was to record the interview. The BF officer said he couldn't as it was illegal, Mr Donny then asked if this BF officer was going to stop him recording. The BF officer replied he couldn't record as phones were not allowed. Mr Donny persisted asking and the BF officer became somewhat aggressive as did Mr Donny. Mr Donny then produced our FOI's and showed said BF officer that recording was allowed and he could do nothing about it. BF officer then caved in. (think it may be of interest to note that Mr Donny was a former union rep)

So, BF officer starts asking questions to Mr Donny (who refused to be separated from Mrs Donny by the way). Mr Donny produces their SOT and says 'l've written it down'. Every question that the Bf officer asked, Mr Donny said 'refer to the SOT'. there arises a question if Mr Donny has ever had any goods seized before. Mr Donny is in his element here and goes into full union rep mode and states categorically that he has and taken them to court and won ... and the lies told by the seizing officer along with said officer producing false and fabricated evidence.

The BF officer does not seem to know what to do according to Mrs Donny. His colleagues have stepped back and the policemen are smiling.  The BF officer looks at the SOT again and then looks at his colleagues and shrugs his shoulders. He then states that 'On this occasion he let them proceed but he will be taking down notes about the stop and search for future reference'.

Mr Donny says 'Good, because he will be putting in a request for this notebook to check what it says'. The BF officer says that he doesn't understand what he means. Mr Donny then explains to this BF officer what an SAR is.  Mr and Mrs Donny then leave with their goods!

Mr Donny tells me that he was polite and considerate up to the point where the BF officer told him he couldn't record the interview. Mr Donny knew it was a complete lie and reacted to it. Thing was, Mr Donny was recording from the moment he disembarked the aircraft on his covert Sony. The overt recording request was for his iphone!  (grin)

Excellent news. Well done the Donnys and I almost pity the BF officer who was unlucky enough to stop them...them who have stood up to, fought and beaten the UKBA and their lies in court before.

This latest Adventure Of The Donnys In UKBA Land not only reiterates the need to record the moment your feet touch Terra Firma and the value of the SOT but also the wisdom in making the Bobi FOI an 'official' attachment to the SOT-downloaded and printed off with it.

I get the feeling that there are BF Officers , who after their 10 weeks of Mc Basic training, genuinely and honestly think that recording is illegal.

*returns to trying to source an offcut of 2" Samco Boost hose* (we all have our problems!).

I love the remark about the 3 police officers smiling at seeing this BF officer out of his depth  (grin)

Appeal to the Crown Court. There is plenty of information here on the site about it. I think I am right in saying that several members here have successfully appealed to a higher court after first losing at the Magistrate's ....mainly due to the whimsical darlings of JPs not having much understanding of the law or undue reverance for the UKBF.

As you read this back do you not think that your posts are a little short on detail to be expecting to receive useful detailed information and help ?

Quite right BS.

I understand there may be language barriers but it hardly inspires a reply. I'm coming to the conclusion also, that those who do not want to tell us the full story via our 10 questions, are smugglers.
If people can't be honest with us then quite frankly I can't be bothered to respond. The only times I do respond in such cases are when there are questions of general interest to all or to correct the wrong advice.
