New procedure or not?

Has anyone received one of these forms? 

Our member has appealed and is awaiting a review decision. The accompanying letter also said they had not received his appeal although he has acknowledgement that they have. 

It has always been an issue that BF when seizing goods say that you can walk away with no further action even though HMRC will pursue you for duty and penalties. I'm wondering if maybe there has been a direction at tribunal level which has caused this procedure to be actioned. Alternatively they have screwed up in our case.

Never seen a letter like that before. Has the member issued a NOC?

NOC issued and acknowledgement received. Restoration denied, review requested.

Well if that is the case there is no need to reply to the letter. Just keep the acknowledgement in a safe place and keep an eye on that 6 month time limit.

Otherwise, I don't know what to made of this letter, perhaps a devious attempt (even by Border Force standards) to induce the person to withdraw his/her appeal ?

As regards restoration, BF must, by law, complete the requested review within 45 days otherwise refusal of restoration is deemed to be confirmed and the person may then appeal to the tribunal.

Might be worth phoning/emailing NPSU asking for clarification. Alternatively the member could just sit tight and see what happens.
