25th Sept Hull Magistrates Court. UKBA v Tony

Should be an interesting day. Come down, meet up, have a few drinks and a chat ...  then see our 'justice' system in action. Atleast 4 people going so far

Tony has now received the copy of the officers notebook. He's going through it word by word and comparing it to the officers written statement and transcript of said notebook. We've always found 'errors' ... things added and things missing. What Tony tells me is that the officer wrote things down and then crossed them out at the time of the interview. Tony refused to sign it or read the notebook at the end of the interview.

What is really interesting is that Tony says that this copy of the notebook has NO crossings out!

Sun Tzu says in the Art of War  "... so in war one must be flexible; he must often adapt his tactics to the enemy situation."

We shall give this some thought.

Indeed...

....very interesting.

You recall my recent 'not a stop' - the video'd one? The officer questioned me but didn't A-J however he did Xray my goods (and fucked up the xray machine doing so) then he also went away to the 'office' with my SOT etc. He was gone some little while.


Yet...according to the SAR I sent he made no notes in his notebook about it...which seems strange to me even if he strictly speaking isn't required to have as there was no seizure. However they did include a paragraph in the SAR-reply that hinted some stuff might be kept secret in the interests of keeping us all secure and all.

Reminder! Tony is at Hull Magistrates on the 25th Sept 10.00am. Come down and lend your support AND see a case first hand. Your support WILL make a difference ... magistrates aren't used to being under scrutiny. They prefer to have such as Tony in court all by himself ... we ain't going to let that happen!

I sent a letter addressed to the most senior officer in their legal team, recorded of course, informing him that the notebook copy that was sent to me was outside the deadline date laid down by the magistrates, also that this copy was not from the original notebook entry, I know this because I observed the interrogator crossing his mistakes out, the notebook copy they sent had no crossings out, I also demanded the name of the case worker, who, for some reason wishes to remain anonymous, and as expected so far, I have had no response.

We hope to be there 10am ( 70 mile via M62, gulp!) It’s a trip down memory lane for Son in Law, roughly 10 years since we took Customs to court and beat them at the same court. Fortunately S.I.L. caught one of them lying early on in the proceedings, the court weren’t to impressed and it was all over for dinner time. In those days we didn’t know about the 144 certificate, so the ‘little tinkers’ got away with costs! Still we walked out with a smug grin on our faces. Here’s hoping for the same Tues!

Sorry we can't be there, 270 miles round trip for us to Hull and we drop off the end of the map before we get to the Land of the Haggis!

Thanks for that, George, they sent me a copy of the notebooks a day after the deadline imposed by the magistrates on the 12th July, that is forming part of my complaint to the magistrates, the councel for UKBA and the UKBA are both in contempt as far as I am concerned, if they deliberately ignore a courts direction.

When they start their interviews they have a few books with them, have you ever noticed that they have some left over after the interview? They will all have the issue date, even the ones that are not used.
At the hearing on 12th July, there were no copies of his notebooks, in my posession or theirs, I did make it a point to the magistrates that he compiled his witness statement from notebooks that I did not sign, and I waved a few pieces of paper at them saying thats how much different the statements are from the actual recording, at first the councel for UKBA tried to get the voice recording disallowed by saying I did not provide them with a copy, I sent them a copy months ago, I misplaced my copies of the letter sent with the disc and the reply letter from them saying they have no facilities to play the disc back, the magistrates have made a note of that and told me to produce these letters and proof of delivery etc, I have got all this for tomorrow!

I will be appealing this decision to the crown court, my weak point was the 4 receipts issued by Real Tobacco for a single purchase, the magistrate took those as a reason to sell to someone, his final comment was that I WAS going to sell my gear, not MIGHT of been, I took that as a personal attack on my good character, there was no just cause for that comment!

good luck with the appeal tony,i have a lot of faith in crown courts,and have had some good results there,not related to ukba seizures though.

a freind of mine appealed to the crown a few years ago,although he lost,the judge was sympathetic and squashed all costs awarded against him at the magistrates.

Others will correct me if I'm wrong but I think once condemnation proceedings are instigated the Tribunal cannot have any further involvement as the magistrates court is a higher authority.
