Well, I don't know how to read the case list correctly but the bench retired to consider judgement at 11:42 and the next entry was hearing finished for Tony at 12:21.

I'm sticking with the "No News is Good News" camp and have decided that the reason we haven't heard anything is that Tony is now pissed as the proverbial, enjoying his goods  (happy)

Tony was so confident of a result,
But the Goons and the judicary all sup from the one trough.

What can one say only it's not a level playing field.

Tony lost. Judge accepted Border Force database wrong, accepted that separate receipts were not proof of commerciality AND that 3kg was the guideline! This came about last Thurs because the prosecuting barrister said that the guideline was 3kg and the judge accepted it (fortunately the Border Force officer was outside waiting to be called as a witness. This is what we were keeping quiet after last Thurs)

Alas, it was to no avail as Tony still lost. l wasn't actually there today as l had just got back from Zeebrugge and my youngest daughter had just returned from USA. Tony gave me that info only.

To rub salt into the wound, the judge awarded another £1700 on top of the already awarded costs of £2719.50.

Total £4419.50

Picking at the bones of it because we have not got any details, if the guideline quantity was given airtime in court, I would interpret that at the very least as meaning that BF will be deemed to have acted reasonably if the shopper is carrying more than the guidelines...therefore s144 cert will be granted.

Human rights may see this as disproportionate if Tony took it to Europe, but maybe his heart is knocked out.
Europe is the only hope of Justice now, being a smoker leaves him disadvantaged in this country. Now if he was from Western Asia or Central Africa, well hell that  would give him a head start, Lawyers would be climbing over each other to help.

I won the battles but lost the war, I proved that their evidence was false because I physically backed it up in the court, I also proved that their database was not accurate, these were the main points that they were relying on to win, the judge dismissed these, by rights the judge should of had him for presenting false evidence, he dismisses it instead, what does that tell you?

I am on the side of right but because I dont have the cash to pay a barrister £400 an hour, I get a raw deal. I am considering my options, officer Loades left the courtroom last week and came back with something that he said was off their database with my name, address and phone number on it, I immediately challenged it because if it were genuine it should of been in my SAR bundle, also it should of been disclosed to me when I asked for everything they intend to use against me as evidence. It was relating to this trip that I did not do last year.

I will complain to the DPU for not disclosing all data that I was entitled to.

I would probably stand a better chance in Strasburg, I am looking at that option now, Ive had a quick look at the rules, it says "when domestic remedy is exhausted"  Do I take this as I have to go to the Appeal Court in London first, hit with more costs etc, because I cant see them agreeing with me and condemming a fellow silk.

Civil justice or quasi justice is no justice Tony, Balance of probabilities is different things to different people and you got a judge that could see no wrong in a goon in uniform,

It is absurd that, in this case, the interpretation is that 3kg is a limit, ahem, guideline. As known and publicised by HMRC and quoted hereby
... "You can bring an unlimited amount of most goods into the UK, for example, you can bring in any alcohol, tobacco, meat and dairy products – as long as they are for your own use and transported by you. ‘Own use’ means for your own consumption or gifts." ...
I'd appeal, however that decision must be made by Tony and Tony alone and respected by the membership. Whichever, onwards and upwards.

I agree i would of been better with a trial by jury, it may be a civil case where the evidence is not as strict as a criminal trial, but the fact is I was pleading "not guilty" to commercial use, and I thought appeals were heard by more than one judge, my fate was down to one liar, one promoter of lies and one that does not punish lies,(on their side of the fence) I have no doubt that if the UKBA could prove beyond doubt that I was selling my gear I would be in the dock on criminal charges!
