Fantastic news!!! Very pleased for you indeed. Obviously winning in court is a very good thing, but also bear in mind that keeping your goods in the first place is better. I'm finding refusal to allow them into my luggage until they open a fresh page of 100A notebook puts them off. Twice now stopped since seizure and they have not even got to touch the zip on my baggage.

Can you please tell me exactly "when" you gave the BF solicitor your "court document pack" and if you asked for a copy of their document pack (and was given it) in advance or also on the day of the hearing as our case is not far away now ................ thanks

I wrote to the Solicitors office and asked for their pack in advance which I received 4 weeks before the hearing, it consisted of 4 pages of 'evidence' and the rest were forms; as they didn't ask for my pack I waited until the morning of the hearing and then handed them my 41 pages bundle...

Needless to say they asked for and got an adjournment for 2 months to allow them to check and verify the statements/evidence in my bundle ...

Firstly, well done on your victory in court

Secondly, l doubt very much that there was any 'intelligence' at all. This claim by BF is standard procedure for them in court. They use it to cover that the stop was random. lt's a ploy used time and time again, they say they have intelligence but cannot say what it is because it would effect their operations and therefore not in the public interest to disclose this intelligence. Unethical tactics by an unethical government agency.

This intelligence will not even be disclosed in an  SAR...  so you cannot challenge the validity of their 'intelligence'. Typical Catch 22.

lt's sometimes worth questioning the BF officer about this i.e. "The truth is Officer, this mythical intelligence does not exist, does it? You use it to cover the illegal stop, don't you? etc etc.

Anyway, as l said earlier ... Well done!

When cross-border shopping, take your Statement of Truth etc and ALWAYS record the Border Force interviews and NEVER EVER sign their notebook ... Period!

yeah,or anywere you travellel by foot.

it doesen't work for me,as my passport flags something up,so obviously they know who i am when they stop me ha ha,despite asking lots of times and umpteen ukbf and even the police who stopped me entering the uk on one occasion what was the reason,none of them knew the answer ha ha.

This is why I always ask them to open notebook 100A and start writing. THEY DON'T WANT TO DO THIS!! It causes paperwork. But I just refuse entry to my baggage until they start writing. They never write anything and I never let them in my baggage. Fair deal.

I gave them my bundle on the day when she introduced herself about a hour or so before proceedings started and they sent us their bundles a few weeks before the court date.

Garry, I think only tribunal decisions and decisions in the higher courts are published on Baiilli. It's a great pity that magistrates decisions are not published because it would reveal what utter clowns many of them are.

ND - I suggest you phone Home Office solicitors and ask them for the seizing officer's witness statement if they have not already sent it to you. You can then check that it is consistent with what was recorded in the notebook.

 yes, the magistrate awarded us £145 which covered petrol cost and hotel for 1 night.
The home office solicitor tried to stop this by quoting some previous case (which refered to a council tax case) where costs had been denied, the bench then consulted the clerk and then they said that the award for costs would stand saying that if the case had gone the other way the home office solicitor would of applied for costs for herself and the BF officers that were called.

Thanks for your reply. One last question regarding costs - did you calculate the amount prior to the hearing and present it to the court? Sorry to be such a bore on this subject, but there is not much information on the site at present regarding this topic.

The bench asked us if we wanted to claim for costs and we must of looked confused, she then went on to ask if we had incurred any costs to attend court suggesting petrol and hotel, we said yes petrol around £80 round trip and £50 for night in hotel plus £15 for breakfast.

Hi I have just had my gv taken off me at Hull.

 I have sent off the notice of claim form but not included any evidence, is this right?

 Should I also send a sar form of and what do I ask for?

Is there anything else I should do?  Also what should I expect to happen next?  

Sorry for the basic questions but I am new to this and it's a bit scary.  I have been encourage be reeding your site, and realise I need a lot of help.
