european courts

Has anyone taken a case to the EU courts ???? It seems to me that you can be prosecuted by the BA/HMRC just on them thinking you may have bought tobacco or whatever on previous trips. Thats like saying if you have been to a mosque where a radical extremist has been before then obviously you are are terrosist as well. Seems a bit guilty until proven innocent just because they think you could be. I just wonder how this would hold up as a point of law in the EU, which is afterall who we have free trade and free movement with

As far as I'm aware you cannot go to the EU court until you have exhausted the state legal process right through to the very end.

To date court and tribunal processes have been found not to be in breach of human rights.
