Latest Information re: Recording of Negative Stops

We now have accurate information regarding your rights to recording a negative stop. It took three re-wordings of the original question but we got there eventually ! http://cdn.boardhost.com/emoticons/grin.png
Basically, although BF do not have to record a negative stop in their notebook even if you request them to do so, they do have to record the fact that you have asked them to do so !!

This could be very useful if a case went to court. BF use the "Balance of Probabilities" to assume that on every trip you have been shopping, you would have brought back the same amount of goods. However, they do not have any proof of this if they didn't record amounts at a negative stop.

When questioned in court, you could produce your SAR and state "I did request the officer to record the details of my goods but he refused and here is the evidence of my request"

Thanks to Shaky for his persistence in seeing this one through.

Couple of points to consider though. It may require a follow up so get the officer's ID. There's no guarantee he will make this notebook record unless you actually see him do it. Further it may be worth a complaint to BF a couple of weeks after the event to say the officer refused to record the event. The reply should come back that the officer did not record because you were carrying nothing of interest and no further action was taken

Please ensure you do not divulge any information which could identify you as Border Force will use your posts here as evidence against you in court.

I really enjoyed reading that. I thought he was gonna keep adding to it for a bit there.  Still blows me away that they have some magic calculator that can work out probabilities when they discard the negative samples.
