If SH can recall on the first crown hearing, the barrister told the judge that the guide levels was 3kg, it was thought that should work in my favour, in the judges summing up it was actually used against me, the judge said that I was clever enough to remain under the guide levels on my previous trips and thats why he dismissed my appeal!

Its a charity that provides legal assistance to those that cannot afford it or where legal aid is not available, they cover all areas of law, you can only be referred by a solicitor, citizens advice, MP etc, there are quite a few top barristers that actually do Pro Bono work!

But it would only be in England Tony, The old boys network calling themselves the Scottish Bar Assoc would never ever stand for that, oh no no no.

The officer suspended the interview while he spoke to his boss, he came back and shortly afterwards asked me if I had a June trip in my SOT, at that time he made it as though I misled him by not mentioning it, I told him that I would not of missed it out on purpose, but he used that against me by accusing me of misleading him, it was only during my research into this, double checking with the bank, ferry companies etc that I discovered that I did not travel in June at all, after that I was convinced that that was purposely put in there to invalidate my SOT

One trip doesn't invalidate your SOT. What's your SOT like? Can we see it if you take your personal details out?

I sent a copy to SH at the outset, but the barrister in the crown court was actually praising my SOT and said it was very good!

Yes really! Border Force have a policy of not recording such stop and searches because they DON'T class it as a stop and search. Of course one would have to be of a devious nature to do such a thing as stating you were stopped when you were not.  (grin)

l love the irony of this. Border Force love to say that all your previous trips were for purchasing tobacco and know the innocent shopper can't prove otherwise. When a shopper says he was stopped and had nothing on him and puts it in their SOT ... Border Force can't prove otherwise!

Border Force are manipulating the stats this way because they don't show ALL the random stops they are doing ... which would be in contempt of the Hoverspeed ruling. Problem is for Border Force that it can still bite them on the ass as we've just mentioned. They're in between a rock and a hard place on this!

I always try and get the ukba id number,and on occasions when bringing in very small amounts i have actually approached a ukba and insisted he write down what i have.

UKBA make assumptions that if they stop you and find say 5kg,they assume you bring in 5kg every time you travel.

This brings in another point that bites them on the ass! Often their id numbers are hidden under the robocop fancy dress and they refuse to give you either their name or id number. l know this has happened to you personally.

So if you state you were stopped on the previous trip and had nothing ... if they ask you for the officers identity one can say that the officer refused to give you it! As l say, they're between a rock and a hard place ... of their own making!
