hi everyone for now i would like to thank all of you that supported us with this case. sh and zap have been fantastic. i want to think before i do a full write up. but at the mo we feel exausted, its been a long day. but WE WON. xxxx

Well done to SH and Zap or indeed all who helped. I knew from the first when I meet you two gentlemen at Hull Court last year, that you would be formidable opponents for the shambles that is known as ’customs’ ( one never knows what there calling themselves, as they change it after every balls-up)

Onwards and up! .

Must confess to being the other half of the bill. My case was something of an anticlimax, being abandoned at half-time so to speak on the grounds of "no case to answer".

Got completely bogged down when cross-examining goonette and the court was only woken from its slumbers by an annoying tune from my new mobile. Every time I switched it off, it seemed to turn itself back on again rather like the many-headed hydra. But then as I said it my very first post, I never was much of a techie.

However, my bundle must have impressed the bench, because they returned after perusing it during a short adjournment and Border Force barrister stated they were not proceeding with the case.

Was able to observe the end of Cathem's case and was truly impressed with their heroic efforts.

Particular thanks due to SH and Zaphod and indeed all members of the forum. I am sure I would not have come through this without their support.

Will post some more in a less frivolous vein when I have caught up on some sleep.

Once again, thanks to all!!!

From the "Glossary" sticky:

Cert sec.144 – something the UKBA will always try and get a magistrate to agree to. Basically it means that even if you get your goods back you can’t claim any other compensation from the UKBA for seizing your stuff illegally (ie you can’t claim for the ciggys you had to buy at UK prices to smoke while your EU fags were in the UKBA’s lock up).

The 144 basically is the Magistrate agreeing the seizure was REASONABLE even if it was wrong or even unlawful!

A cert 144 WAS issued somewhat to my annoyance. However, I did ask the clerk about costs and he referred it to the magistrates, so I am hoping to be able to claim something.

As this topic is of interest to other members, I am starting another thread.

I would be very interested to hear more about your day in court and your sucess. We will see in court early next year and I would like to know your judgement and what was said during the hearing as there may be something that will help us.

Just goes to show that most Magistrates don't live in the same universe as the rest of us!


They lie on recordings; they lie on oath; their shysters lie on their behalf. Don't believe a word coming from the mouths (2 per person) of any UKBA officer.
