Those receipts could of been used by customs in two ways, 1, For them to accuse me of commercial use, 2, For them to approach the tobacco manufacturer and accuse them of not sticking to the supply chain agreement and give them a hefty penalty!

It says "Commercial Quantities" these quantities will be on the Supply Chain Agreement between the manufacturer, the wholesaler and the retailer, and this has to be provided to customs on request to show that there is an agreement in place!

Cheers deano, I might get a judge that believes in fair play, not one that decides against you before he has heard the facts!

I am all set now for Thursday morning at Hull Crown Court, I have been over and over my papers and evidence and all placed in order of play, I am hoping that their bunch of lies don`t get past this court!

Thanks for that, eezyrider, Ive got the whole of Customs & Excise Notice 477 printed off, Section 3 of that notice is what I will refer to in court, its possible that the barrister or judge will not be familiar with it, but you can bet your life that UKBA are!

Ive looked over the site too, they will consider cases where you have at least 4 weeks before any hearings, I may send them a message later with an outline of my case.

They have a list of cases that they wont deal with and I did not see customs cases in that list, it will be interesting to see how they react.

We need a radio station that is willing to air this problem, on the other hand by blowing off steam on air to the country might only get us laughed at, all those/me/us that have been subject to this persecution need to stand together and fight them, Im not scared of them, and I dont mind the public knowing that its me making the waves. I contacted a solicitor in Oldham (he was suggested in here, not to me directly, to the forum as a whole) I gave him an outline of my case, the 100% evidence in my favour proving fake evidence and lies, I sent this info weeks ago and he has not had the decency to reply. I suppose he needed to know what my bank balance was first!

I got another letter this morning, its now on the "Criminal" warned list for 19th November,

A warned list is that it can be heard on, or any time after that date, what has puzzled me is the letter from Hull Crown Court, it says it is on the "Criminal" warned list, these cases are civil!

I would request confirmation in writing also.

I have recorded the telephone call and Ive got the date, time and persons name that signed for the letter of appeal notification, they told me that the crown will get in touch with date of hearing etc.

Ive been to a VAT Tribunal a few years ago, they are a kangaroo court just like the magistrates. In one of the letters from UKBA about appealing seizures, they say if I appeal to a Vat Tribunal, they will request that the appeal be struck off because they dont have the jurisdiction over the magistrates.

I went to the Appeal Courts in London a few years ago following a hearing in Liverpool Magistrates, the customs said that a Vat Tribunal does not have Jurisdiction over the Magistrates, but the judge who looks at appeal applications to decide whether a case can go for a full appeal hearing said that a Vat Tribunal DOES have jurisdiction over a magistrates court, in other words, it does have the power to overturn a magistrates decision!

I will be appealing this decision to the crown court, my weak point was the 4 receipts issued by Real Tobacco for a single purchase, the magistrate took those as a reason to sell to someone, his final comment was that I WAS going to sell my gear, not MIGHT of been, I took that as a personal attack on my good character, there was no just cause for that comment!
